TERMS AND CONDITIONS OF USE:-

Thank you for visiting the Krishna Ecommerce Technologies Private Limited   web site (the "Site") www.lensbazaar.com . Krishna Ecommerce Technologies Private Limited is a leading online retail store and information site for contact lenses and related products. The Site is designed by us, Krishna Ecommerce Technologies Private Limited ., ("we" and "us") a company with limited liability situated in and vested under the laws of the New Delhi, to provide a convenient, private and informative shopping experience for consumers to purchase contact lenses and related products 24 hours a day, 7 days a week. We offer a large selection of contact lenses and related products, along with a wealth of information designed to help consumers make educated purchasing decisions. We want each visitor to the Site ("you") (i.e. any natural person acting on the Site with purposes having no relationship to his/her commercial or professional activity) to have a safe, pleasurable visit, so we have established the following general terms and conditions so that we (we and you) know what to expect from each other.

These general terms and conditions (which include the returns policy, intellectual property policy and privacy policy) are applicable to any use of the Site and to any agreements concluded between you and us through the Site. If you do not agree to these Terms and Conditions, you cannot use this Site and/or buy any products or services through this Site. We may make changes to the Site, these Terms and Conditions of Use, or the policies and conditions that govern the use of the Site at any time. We encourage you to review the Site and the General Terms and Conditions periodically for any updates or changes. Your continued access or use of the Site shall be deemed to be your acceptance of these changes and of the reasonableness of these standards for notice of changes.

 

WE DO NOT PRESCRIBE CONTACT LENSES OR ANY OPTICAL LENSES :

Prescribe means advise and authorize the use of lenses in writing -  Only a qualified Optician / Optometrist / Eye Specialist can Prescribe Contact Lenses

We are resellers of contact lenses and do not prescribe contact lenses to our existing or new customers. If you are a first time user of contact lens, we recommend you to first visit a qualified optician, optometrist, eye specialist and ask them for a contact lens usage guidelines along with brand of lens which will suit you.

Once a qualified optician, optometrist, eye specialist examine your eyes and recommends you the correct contact lens for you, we will be happy to send your lenses to your doorstep


 

RETURNS POLICY:

 

Our return policy is designed to help geniune replacement quickly and free of cost

We offer a Limited returns for the product sold on our website www.lensbazaar.com , which means, we reserve the right to reject any return our management believes is not true in general business natural

General returns not acceptable

 

For every return we may demand previous proof of purchase of using same lenses to ensure customer have ordered correct lenses and are geniunley defective 

For every return must match recorded LOT number mentioned at the time of purchase on customer purchase invoice shipped via each order

 

On case to case basis we will charge you Rs 250 for a reverse pickup inclusive of all taxes (for Surface express)

 

 

BROKEN LENSES POLICY

 

Possibility of soft contact lenses to break

 

We understand that sometimes lenses breaks during normal usage even though new or experienced contact lens user may break lenses during normal usage and such lenses must not be used at all , however, we regret to inform such lenses are also not liable for returns or replacement policy of our company

 

We request all lens users to be gentle while handling your contact lenses and only follow optician / eye doctor / optometrist advised procedures

 

Possibility of Errors :-

Our content management team regularly scan websites for errors such wrong product info

We ensure that all parts and content of our site is regularly updated with product information as and when available from manufacturers, however, there are chances although VERY RARE, that content published may have some errors in typo or content transfering from one application to another.

We apologize if you encounter such error and report to us so our content management team can correct them immediately  

Also do note , such errors have no implications for customers to purchase there contact lenses as we resell contact lenses and do not prescribe them

 

YOUR ACCOUNT OBLIGATIONS:-

In consideration of your use of the Site, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the checkout form for your account information (the "Account Information") and (b) maintain and promptly update the Account Information to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we may suspend or terminate your account and refuse any and all current and future use of the Site. Account Information and certain other information about you are subject to our Privacy Policy. Please review our Privacy Policy (below) to understand our privacy related practices.

YOUR CONDUCT:-

Any conduct by you that in our sole discretion restricts or inhibits any other user from using or enjoying the Site will not be permitted. You agree to use the Site only for lawful purposes. You are prohibited from posting on or transmitting through the Site any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, fraudulent, racially, ethnically, or otherwise objectionable material of any kind, including but not limited to any material that encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, national, or international law.

You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Site, use of the Site, or access to the Site unless you first obtain our express written consent to do so. You agree not to access the Site by any means other than through the interface that is provided by us for use in accessing the Site.

VALID PRESCRIPTION REQUIRED:-

You hereby certify that you have a valid prescription  or having atleast the knowledge of your current prescription for the contact lenses or the optical frames and lenses that you are ordering. You represent and warrant to Krishna Ecommerce Technologies Private Limited by placing an order that your information you enter into the Site is valid and true and matches exactly your prescription as provided by your eye care provider. You further certify that you will renew your prescription in strict accordance with your eye care providers suggested regime. By ordering online on our website you hereby CERTIFY that you are aware of your current prescription or you may contact your eye care practitioner to obtain such information or you may consent to our contacting your eye care provider, if necessary, to verify your prescription information and any other necessary information. Us Contacting your eye care practitioner has to be given us in writing via e-mail or in writing to our postal address mentioned on contact us page

COLOR AND PRODUCT DESCRIPTION:-

We have made every effort to display as accurately as possible the colors of our products that appear at the Site. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitors display of any color will be accurate. We have attempted to be as accurate as possible. However, we do not warrant that the product descriptions are accurate, complete, reliable, current, or error-free. If a product offered by the Site is not as described, your sole remedy is to return it in unused condition.

DELIVERY:-

Deliveries will be as soon as possible to the address on your order and are "best effort" based. Subject to delays outside our control, the overall delivery period will not exceed 30 - 60 days

Should this happen where some lenses require special arrangement to be imported into India an additional delivery timing may exceed 60 days and upto 180 days or given in writting time to time via email ticketing support

Any customer not accepting the delivery terms may apply a refund

 

Cancellation Policy

If customer has paid online via credi card, debit card, netbanking, or any prepaid mode of payment and would like to cancel the order before it is shipped - therefore such customer can apply a 100% refund without any levy of fees 

Cancellation policy is only applicable if the goods are not shipped only 


 

Delay in Orders

 

Due to market circumstances and unforeseen supply chain fluctuations, any order placed at LensBazaar can be delayed subjected to minimum 60 days and maximum 180 days, because of such delay, any customer can place a order cancellation as per Cancellation policy at any point of time



 

COOLING-OFF PERIOD:-

Return any products without any damages in true shape and size to us within 7 days and we will accept the returns.

However, this does not apply on Optical Lenses which are fit onto your Spectacle Frames and Sunglasses

RETURNS POLICY:-

We will issue a full refund or replacement of goods in all instances where:-

1. prescription contact lenses or related products are supplied to the wrong specification as per your prescription;

2. contact lenses or related products are supplied damaged; and

3. the products you have ordered are returned to us as undeliverable by the logistics service

4. RTO cases will have fees of Rs 750 each return plus any other administrative fees levied from us time to time

5. Abandon packages (packages returned back to us as customer not responding) will have restcking fees of Rs 1000 + 18% GST , subject to our option to reship at additional fees may be decided later

In all instances (save returns to us as undeliverable) you should contact our customer services to request a return and the relevant return address. A refund or replacement will be issued to you following their receipt at that address within 30 days of that date. If goods are returned as undeliverable, you will be contacted by email for confirmation of the delivery address. If no reply is received within a reasonable period and in any event within 30 days of the return of the goods, then a refund will be made within 30 days of that date.

You shall pay the postal charge for goods returned under this article. We may refuse to accept future orders from those who have made previous unsubstantiated claims for non-delivery of goods. Refunds will be limited to the maximum value of the original order and will only be issued against the same credit or debit card account as supplied to pay for the goods. We reserve the right to proportionately reduce the level of the refund if only some of the original quantity of contact lenses or optical products is returned, or if it is clear that some of the products have been used. In the case of goods returned under your cooling off right, these must be returned undamaged and unused to qualify for a refund (no open packages).

 

EYEGLASSES / SPECTACLES GLASSES POLICY

Shipping and Payment:-

If you order frames with single vision lenses, we will manufacture your order within 2-7 business days and then ship it to you according to your chosen delivery method. If you order frames with an upgraded lens option, such as tinting, progressive lenses or higher index lenses, we will manufacture your order within 5-12 business days and then ship it to you according to your chosen delivery method. Your overall expected delivery date will depend on the delivery method chosen.

Please keep in mind that quality assurance technicians inspect and verify each and every eyeglass order. If your eyeglasses happen to fail quality assurance, your expected delivery time will be delayed.

We accept the following forms of payment: Visa, Mastercard, Discover, Amex or PayPal. Payments can be made online or by phone with approval from Payment Gateway authority

Selective Return Policy

Our 100% Satisfaction Guarantee means that you can trust Krishna Ecommerce Technologies Private Limited  to deliver high quality, brand name eyeglasses to you at affordable prices.

We are currently unable to accept returns of eyeglasses if the eyeglasses or their complimentary accessories are not in their original merchantable condition, or if the eyeglasses or their complimentary accessories are returned more than 365 days after the date of purchase. Krishna Ecommerce Technologies Private Limited  offers a 1 year warranty on manufacturer defects on frames and lenses. For all warranty issues please contact our Customer Care representatives at admin@lensbazaar.com for further instructions. In the case of defective lenses, please contact us immediately. If lenses are deemed by the manufacturer to be defective, we will issue you a refund.

 

Prescription:-

When you are fitted for eyeglasses by your Eye Care Practitioner, they should provide you with a paper copy of your prescription. Keep in mind that spectacle and contact lens prescriptions can be different, so you should ensure that you are ordering the parameters for your spectacles and not for your contact lenses.

 

TRADEMARKS:-

Krishna Ecommerce Technologies Private Limited  The Contact Lenses Store and other graphics, logos, and service names used on the Site by Krishna Ecommerce Technologies Private Limited  are the trademarks of Krishna Ecommerce Technologies Private Limited . Krishna Ecommerce Technologies Private Limited  trademarks may not be used in connection with any third-party products or services or in any manner that disparages or discredits Krishna Ecommerce Technologies Private Limited . All other brands and names (including third-party product names) are the property of their respective owners.

 

EXPORT:-

As per Indian Export Laws goods imported does not require authorisation for re-exports unless and until they are prohibited by the law

 

INTERNATIONAL ORDERS (all orders Outside India)

Customer has to ensure they conform all compliance regulations of importing goods in their country including formality of clearance, brokerage , any other regulatory compliance 

All cost which are part of import country including duties, taxes, regulatory charges, VAT , any other charges imposed by courier company are payable only by the customer

LensBazaar.com is not responsible for any charges mentioned above

Returns from International Orders are only subject to approval and customer must pay all return postal costs / courier costs

In event where customer refuses to pay for international duties and customs taxes, a possibility of shipment destruction may arise and this will be the full liability of the customer ordering the lenses. Such scenarios to happen customer is liable to pay all duties and taxes from their credit card which was used to pay while placing an online order.

 

All international customer while placing an order are automatically consenting to below

  1. Your order will be auto-shipped without additional approval
  2. You will provide contact lens prescription when demanded by us or by logistics company or by an external regulatory authority
  3. You are an Indian resident visting international location for business and tourism purpose and order lenses for your personal usage (in case you are foreign resident and prescription is demanded by regualtory agency, we will communicate you to provide the prescription within  7 days - failure to do so may result in refusal of the package and any package which is refused by regulator will be abdanded at the port of discharge resulting in additional abandan fees or charges which may be uptp 50% or more cost of your package) 
  4. You are a frequent use of the ordered contact lenses 
  5. You are aware that the ordered product is available in Indian market under different packaging and you are fully consent to all risk of importing this contact lens for my personal use into
    country of import and you will not resale this product to anyone else other than my own use
  6. You also take full responsibility to pay any import duties and taxes for importing into
    a different country and will not make LensBazaar responsible for any duties or taxes in country of import and in an event goods are not cleared for import, will bear all expenses of return back to origin
     
    7. Internatioanal import order into customer requested juristiction if for any reason if not cleared by customs or any regulatory authority such as FDA or health agency, your package will be abandoned and destroyed by regulators with cost to be borne upon importing customer.
        LensBazaar can seek remedy to recover any charges levied by customs / FDA / regulator / including logistics company such as Fedex or others
       
    8. Customer can request package back to origin provided 50% additional upfront payment to made to LensBazaar in advance to movement of RTO (Return to origin)  

     


 

OUR RIGHTS:-

We may elect to electronically monitor areas of the Site and may disclose any Content, records, or electronic communication of any kind (i) to satisfy any law, regulation, or government request; (ii) if such disclosure is necessary or appropriate to operate the Site; or (iii) to protect our rights or property or the rights of the users. We are not responsible for screening, policing, editing, or monitoring such Content. If notified of allegedly infringing, defamatory, damaging, illegal, or offensive Content, we may investigate the allegation and determine in our sole discretion whether to remove or request the removal of such Content from the Site.

We may terminate your access, or suspend your access to all or part of the Site, without notice, for any conduct that we, in our sole discretion, believe is in violation of any applicable law or is harmful to the interests of another user, a third-party or us.

Because customer service is paramount to our business, we reserve the right to refuse to sell products to you if it reasonably appears to us that you intend to resell the products. In addition, we reserve the right to limit quantities of items purchased by each customer.

 

TERMINATION:-

These terms are effective until terminated by either party. If you no longer agree to be bound by the Terms and Conditions of Use, you must cease your use of the Site. Subject to applicable law, we reserve the right to suspend or deny, in our sole discretion, your access to all or any portion of the Site with or without notice. You agree that any termination of your access to the Site may be effected without prior notice, and acknowledge and agree that we may immediately deactivate or delete your account and all related information and files in your account and bar any further access to such files or the Site. Further, you agree that we shall not be liable to you or any third-party for any termination of your access to the Site.

 

APPLICABLE LAW:-

We make no representation that the Content in the Site is appropriate or available for use in other locations, and access to it from territories where its content is illegal or prohibited. Those who choose to access the Site from other locations do so on their own initiative and are responsible for compliance with applicable local laws. You may not use or export the Content in violation of U.S. export laws and regulations. Any claim relating to the Site, the services provided through the Site or the Content (a "Claim") shall be governed by the internal laws of the Province of New Delhi and the federal laws of India applicable therein, without reference to any choice of law provisions. You hereby irrevocably consent to the exclusive jurisdiction and venue of courts in the Province of New Delhi, India and irrevocably agree that all Claims may be heard in such court. You agree that a final judgment in any such action or proceeding shall be conclusive and may be enforced in other jurisdictions by suit on the judgment or in any other manner provided by law.
